Notes on privacy policy when applying for employment (Article 13 of the DS-GVO, the German General Data Protection Regulation), last updated February 2019

 

In the following, we will inform you about the collection of personal data regarding applications for employment.

 

Definition personal data

Personal data are all data that is relatable to you as a person, this means, e.g. name, address, email address, application photo, information provided in your CV such as school and employment career, achievement evaluations (school reports or report cards), marital status or date of birth.

 

Responsible parties

According to Article 4, clause 7 of the German General Data Protection Regulation, Mörtlbauer Baumaschinen Vertriebs GmbH is the party responsible and is represented by its managing directors Armin und Walter Mörtlbauer, Aspertsham 10, 94081 Fürstenzell.

 

Data sources

We process personal data which we have received either from you or from a recruitment agency (e.g. employment office) in the process of deciding on the reasoning of an employment.

 

Purpose and legal basis of the processing

The data will be processed by us, provided that this is necessary for deciding on the reasoning of an employment. The legal basis for this is § 26, clause 1 of the BDSG (the German Federal Data Protection Act), in conjunction with Article 88, clause 1 of the German General Data Protection Regulation (DS-GVO).

 

Transmission of data

The transmission of data will only occur within the company you applied for and only to those positions within the company that need the information to make a decision on the employment.

Job processors (Article 28, DS-GVO) employed by us can also receive the data for the above-mentioned purpose. Job processors are companies in the categories of IT services and telecommunication. With those companies, we have come to an agreement in terms of data protection and regarding the protection of your data in accordance with legal requirements.

 

 

 

Data security

We maintain technical and up-to-date measures to guarantee the security and protection of personal data. These are adapted to the most recent state of the art.

Storage period

Personal data will be stored only for the duration until the purpose of the storage has been fulfilled, legal retention obligations occur or as long as the data is needed for securing and enforcing statutory claims.

Your rights

You have the right to demand information at any time about your personal data stored by us (Article 15, DS-GVO). This also includes the recipients or categories of recipients to whom your data will be forwarded and the purpose of the storage.

Furthermore, you have the right to demand the correction of the processed information in accordance with the requirements of Article 16 DS-GVO, also to demand the deletion of said information in accordance with the requirements of Article 17 DS-GVO and/or to demand the restriction of such information in accordance with Article 18 DS-GVO.

In addition, you are also allowed to demand a data transmission at any time in accordance with Article 20 DS-GVO.
